The United States Citizenship and Immigration Services (USCIS) has published a new memorandum, according to which immigration officers can now deny a petition without sending the applicant a letter requesting evidence (RFE) or a Notice of Intent to Deny (NOID).
According to the director of USCIS, Francis Sissna, this innovation will speed up the processing of petitions, as officers do not have to waste time writing requests or notifications.
“As a result of the policy change, USCIS is restoring full discretion to our immigration officers to deny incomplete and inadmissible petitions,” the USCIS Director added.
New rules allow officers to reject a petition without prior notice to RFE or NOID when necessary. This policy is designed to ensure that applicants are diligent in gathering and providing the necessary evidence.
Official letters will be sent if:
- the applicant cannot, by law, claim what he requires;
- Documents submitted to the program, which is already closed;
- in the package of documents there are not enough documents that do not have special importance.

The updated manual comes into effect on 11 September 2018 of the year and applies to all petitions except those related to the DACA program.
