FedEx files lawsuit against 'Trump tariffs'

Global shipping and mail company FedEx has filed a lawsuit demanding a full refund of Donald Trump's emergency tariffs. This follows a US Supreme Court ruling that invalidated the new import taxes, according to reports. Air force.

The US president imposed increased tariffs on imports from most countries last April under the International Emergency Economic Powers Act (IEEPA). However, the US Supreme Court ruled last week that the law did not allow him to impose such duties.

The decision opened the door for companies to claim back additional import duties paid since they were introduced last year.

"Plaintiffs seek a full refund of all IEEPA duties they paid to the United States," FedEx stated in its court complaint.

The company did not specify the amount of the refund it is seeking in its lawsuit. It named U.S. Customs and Border Protection (CBP), CBP Commissioner Rodney Scott, and the United States as defendants.

The lawsuit was filed in the US Court of International Trade.

In a statement issued on February 23, FedEx said it had "taken necessary actions to protect the company's rights as an importer to obtain a duty refund" from CBP following the Supreme Court's decision.

On February 23, 22 U.S. senators (all Democrats) introduced a bill that would require the Trump administration to fully refund (with interest) all tariff revenue within 180 days.

The bill requires CBP, which will administer refunds, to prioritize small businesses.

The Trump administration is estimated to have earned at least an additional $130 billion from tariffs imposed on most goods imported into the United States under the IEEPA.

While the court's ruling found that Trump's IEEPA tariffs were illegal, it provided no guidance on how to refund those who paid the tariffs.

Speaking after the ruling was released, Trump and Treasury Secretary Scott Bessent said the refund issue could drag on in the courts for years.

In the weeks leading up to the February 20 ruling, hundreds of companies, including cosmetics giant Revlon, aluminum giant Alcoa, and importers of food products like canned fish company Bumble Bee, filed lawsuits challenging the duties to seek refunds.

Costco was also among the companies that preemptively filed a lawsuit against the Trump administration last year, writing in its lawsuit: "The text of the IEEPA does not use the word 'duty' or any term of equivalent meaning."

On February 20, Trump signed an executive order introducing alternative legislation, Section 122 of the Trade Act of 1974, which would impose a new temporary 10% tariff on goods from all countries. On February 21, he announced that he would increase these new tariffs to 15%.
