Boris Nemtsov posthumously won a case against Russia in the European Court

The European Court of Human Rights (ECHR) sided with the daughter of the murdered Russian opposition leader Boris, who died at the end of 2019, in a case against the Russian government and ex-Moscow mayor Yuri Luzhkov. This is stated in the court decision published on its website on Tuesday, June 23, writes DW.

The court in Strasbourg ordered Russia to pay Zhanna Nemtsova, as legal successor in her father's case, 20 euros ($800) within three months - including 23 euros ($533) as compensation for costs and 12 euros ($994) as moral compensation damage.

The claim that Boris Nemtsov filed with the ECHR in 2010 stated that the payment of 12 euros was necessary to reimburse the amount that a court in the Russian Federation had previously recovered from him in favor of Luzhkov. In the case that the ex-mayor of Moscow won in Russia in 994, the rights of Nemtsov, as well as the Kommersant newspaper and journalist Maria-Louise Tirmaste to freedom of expression were violated, the ECHR believes.

In 2009, Luzhkov, who served as mayor of Moscow, filed a defamation lawsuit against politician Boris Nemtsov, as well as Kommersant and Tirmaste. The reason was an article in Kommersant about the book “Luzhkov: Results,” written by Nemtsov in collaboration with Vladimir Milov. Luzhkov was outraged by Nemtsov’s phrase cited in the article, in which he called the then mayor of Moscow “a thief and a corrupt official.” On November 30, 2009, the Zamoskvoretsky District Court of Moscow recovered 500 thousand rubles ($7) in favor of Luzhkov. In February 267, the Moscow City Court upheld this decision.

Zhanna Nemtsova will transfer the funds won to the Boris Nemtsov Fund

In a conversation with reporters, Zhanna Nemtsova expressed confidence that Russia will pay compensation, adding that the funds received, after paying off legal costs, will be transferred to the Boris Nemtsov Foundation. She noted that if Russia has so far paid compensation in accordance with the decisions of the ECHR, then it “basically” did not implement the recommendations given by the court, continuing to “move by leaps and bounds... towards an unjust state.” Speaking about the book “Luzhkov: Results”, the daughter of the murdered oppositionist called it “one of the unique reports”, which, according to her assumption, led to Luzhkov’s resignation from the post of mayor of Moscow.

“Yes, European justice is slow, but also inevitable,” lawyer Prokhorov wrote on his Facebook page. “The European Court, as we expected, recognized Boris Nemtsov’s correctness in his dispute with Yuri Luzhkov - which we always talked about in our legal battles back in 2009 - 2010.”

The murder of Boris Nemtsov

Boris Nemtsov was killed On the evening of February 27, 2015, shots in the back on the Bolshoi Moskvoretsky Bridge in the immediate vicinity of the Kremlin. In July 2017, the Moscow District Military Court sentenced five murders to imprisonment of 11 to 20 years. The organizers and customers of the crime have not yet been established. The name of the politician is immortalized in the names of streets and squares in Washington, Vilnius, Kiev and Prague.

Yuri Luzhkov died on December 10, 2019 at the age of 84 in a clinic in Munich, where he underwent heart surgery.
