The Justice Department said in a statement that Apple did not employ U.S. citizens or permanent residents in jobs that fell under the federal program allowing employers to sponsor immigrant workers for green cards (PERM), in violation of federal law prohibiting discrimination based on citizenship. .
The settlement is the largest in Justice Department history related to citizenship discrimination claims, agency officials said. In accordance with it, Apple must pay $6,75 million in civil penalties and $18,25 million to an unspecified number of affected workers.

Apple noted that it "inadvertently failed to follow department standards."
“We have implemented an effective turnaround plan to meet the requirements of various government agencies while continuing to hire American workers and grow in the United States,” the company said.
According to the Department of Justice, Apple did not advertise jobs on its website that were covered under a project called the Permanent Employment Recognition Program (PERM) as it typically does for other positions. In addition, the company required applicants for these positions to mail paper applications, although it generally allows applications to be submitted electronically.
“These less efficient hiring procedures almost always resulted in few or no applications from candidates whose work authorization had not expired for PERM positions,” the department said.

The Justice Department did not specify which Apple jobs were affected by the hiring procedures or how Apple might benefit from them.
Foreign labor is often cheaper than hiring American workers, and immigrants who rely on their employers to sponsor a green card are considered less likely to leave for other jobs.
Along with the payment, Apple agreed to bring its PERM hiring practices into line with its normal hiring practices. Under the terms of the settlement, the company will have to do more recruiting and train employees on anti-discrimination laws.
