Lawyers fear that it will be harder to get political asylum in the US

Lawyers from Florida claim that the new US government can change the deadlines for applying for political asylum, writes wlrn.org. This, in turn, will affect the overall process of obtaining this status in the United States. But so far we are talking about cases that came to the immigration court.

The basis of any case about political asylum is evidence collected from the country where the immigrant came from. The clients of South Florida lawyers are primarily from Central America. Therefore, in order to receive any documents from this region, lawyers have to wait several months, or even a whole year.

Lawyer Andrea Kramrin told reporters the story that occurred a few days ago. A woman defended her client in a federal immigration court in Pompano Beach. According to the lawyer, the judge stated at the trial that the asylum case should be ready in 30 days. Kramrin believes that such deadlines for such cases are simply unacceptable.

Crumrin's client is a 35-year-old woman from Honduras. In her native country she was raped, and local police even tried to kill the woman. After her injuries, Crumrin's client underwent several surgeries and then fled to the United States to seek asylum.

The lawyer now has exactly 30 days to collect all evidence of the threat to the life of her client in Honduras.

“It's a big difference. Either it takes several months to collect the case, or get documents from my client’s home country in 30 days! And if we don’t have any papers, then the judge can easily dismiss the case,” said Andrea Crumrine.

South Florida lawyers are concerned about this situation. They say that now the Trump administration has accelerated the process of deportation of illegal immigrants. It is possible that the same task began to be performed by the officers and judges involved in cases of granting political asylum. This can lead to an increase in refusals in such cases, according to lawyers.

“Time, that is, timing, is a very important detail that was on the applicants’ side. And now they can reduce the filing time,” says an immigration law expert at the University of Miami Law School.

The authors of the article claim that judges in South Florida are increasingly denying asylum to applicants.

Federal immigration judges are not authorized to speak to the media. But officials at the Justice Department unit that oversees these judges said there is no guidance yet on how to speed up asylum cases. In addition, the department said that such courts still need additional staff.

Attorney Rachel Diaz is also puzzled by the problem of collecting evidence for his client from Guatemala. The judge of the Federal Immigration Court in Miami gave her exactly one month to prepare a case for asylum.
