Trump administration wants to cancel ObamaCare through court

The administration of US President Donald Trump is changing the course of action regarding the Affordable Care Act (ACA), which is often called ObamaCare, and the White House is now seeking to repeal this law completely.

In its appeal to the federal appeals court, the Department of Justice stated that it agreed with the December ruling of a federal judge in Texas, in which one of the major legislative achievements of the Obama administration was declared unconstitutional, writes Fox Business.

“The Department of Justice has determined that the district court's decision should be affirmed,” the document states.

If ObamaCare is abolished, then by 2026, about 32 million people will be left without health insurance, according to a report from the Congressional Budget Office of 2017. Average premiums can also increase dramatically as a result of the cancellation of this program.

“The Department of Justice has determined that the district court's comprehensive opinion reached the correct conclusion and will uphold it on appeal,” said Department of Justice spokesman Kerry Kupec.

The abolition of the ACA was the long-time goal of President Trump and the Republicans, but they could not do it in the 2017 year, because the Senate failed to collect the required number of votes.

Speaker of the House of Representatives Nancy Pelosi (Democratic Party) called this decision "a full-scale war for affordable and reliable health care."

“In the courts, in Congress, across America, Democrats will fight tirelessly to #ProtectOurCare,” she wrote.

In December, District Judge Reed O'Connor in Fort Worth sided with a group of Republicans - Texas Attorney General Ken Paxton initiated a lawsuit brought by 19 states calling for an end to ObamaCare. The lawsuit alleged that Congress repealed a key provision of the program when it passed the 2017 tax reform. This reform eliminated the individual mandate requirement, which required Americans to either obtain health insurance or pay a fine.

Initially, after adoption, the Supreme Court upheld ObamaCare on the grounds that the individual mandate was to a certain extent taxable. Although it is not possible for Congress to demand that people buy health insurance, a car, or a house, this particular provision was considered part of the tax powers of lawmakers. But when Congress abolished this requirement, it essentially destroyed the tax portion of the law. The states in their lawsuit argued that the entire constitutional basis of the law on health care has disappeared, which means that the whole law is unconstitutional.

“The individual mandate can no longer fairly be construed as an exercise of the taxing power of Congress and is still impermissible under the Interstate Commerce Clauses, meaning the individual mandate is unconstitutional. And yet the individual mandate is necessary and inseparable from the rest of the ACA." declared judge O'Connor in his decision.
