Trump administration tightens immigrant work permit rules
On August 19, the Trump administration issued new guidelines to tighten discretionary work permits for immigrants who are temporarily allowed to enter the United States for “urgent humanitarian reasons or because of significant public interest,” in accordance with the Immigration and Citizenship Act.
This step was taken a week after the White House issued long awaited rule, allowing federal officials to refuse to issue green cards to immigrants who are allegedly likely to rely on social assistance from the state, writes Fox News.
Section 212(d)(5)(A) of the Immigration and Nationality Act gives the Department of Homeland Security the authority to decide when to allow entry to aliens under “extraordinary” circumstances, such as visiting a dying relative or receiving life-saving medical treatment. Single entry is a privilege, not a right, and administration officials have made it clear that officials fear abuse.
“Directly closing the loopholes that enable the exploitation of our immigration system is the only path forward,” said the acting director of US Citizenship and Immigration Services. USCIS Ken Cucinelli. “Responsible leadership enhances our ability to provide assistance to those who are eligible. USCIS will act within its authority to grant employment authorization after considering all factors on a case-by-case basis. The US Citizenship and Immigration Services said the new guideline emphasizes "using freedom of action to determine whether or not foreign citizens who enter the United States should be granted work permits in accordance with existing policies."
The newsletter also “provides a list of positive and negative factors that the employee may consider when comparing circumstances and determining whether the applicant deserves a favorable decision,” according to USCIS.
The White House claims that it was strict immigration policy that caused a reduction in the number of immigrants detained at the border.
