San Francisco wants to ban the sale of electronic cigarettes

The two San Francisco officials, 19 March, have put forward a new bill that proposes to ban the sale of electronic cigarettes in the city until the Food and Drug Administration (FDA) does a study to assess their impact on public health.

According to the bill, any sale (in a physical store or online) of an electronic cigarette that has not passed the FDA test will be prohibited, writes Fox Business.

“By law, before a new tobacco product is marketed, the Food and Drug Administration must conduct an inspection to evaluate its impact on public health. It is inexplicable why the FDA is not doing its job when it comes to e-cigarettes. Until the FDA does this, San Francisco must take action,” said San Francisco Attorney Dennis Herrera, who co-sponsored the bill.

Until now, no electronic cigarette sold in the United States has been approved by the FDA.

Inspector Shaman Walton, who also co-authored the bill, presented a separate piece of legislation prohibiting the sale, production and distribution of all tobacco products, including electronic cigarettes, in the city of San Francisco.

Since the law would not be retroactive if passed, Juul Labs, the most popular privately held e-cigarette maker, would be able to remain in its leased headquarters space at Pier 70 in San Francisco. However, if the law is passed, the company will not be able to sell its goods in the city.

But Walton said the law should serve as a warning for Juul Labs.

“We don’t want them in our city. I don't want to see them leave this town. I wish they weren’t there yesterday,” he said.

In November 2018, US health officials took an almost unprecedented step towards restricting the use of e-cigarettes among young people, limiting the sale of these products to fragrances that are popular among young people in small stores and gas stations.

At the same time, Juul Labs stated that the company shares San Francisco's concerns about the use of vape products by young people, but warned that restricting access to electronic cigarettes could harm adults who use these products in an attempt to quit smoking.

“We call on the City of San Francisco to strictly limit youth access to e-cigarettes, but to do so in a way that preserves the ability to destroy combustible cigarettes. This proposed legislation begs the question: Why would the city be comfortable with regular cigarettes on shelves when we know they kill more than 480 Americans a year?
